Before that he had two physicals a year for years and was always told by his doctor that he was in perfect health,”keep doing what you’re doing” he was told.Last July he caught pneumonia,normally a routine hospital stay,he lost consciousness late that night (11:30pm) never regained.Three days later he was diagnosed with fisiculitis,his lungs were bleeding from the inside,a condition thats very hard to stop.The physician in charge said that although this was very rare for a man his age,if it would have been caught in time it could have been prevented.My question is: why didn’t my father’s regular doctor manage to see this? His doctor was from the V.A. and my dad passed away inside a V.A. hospital.

I have no idea how to get out of this. A divorce takes 6 months ( I live in Michigan) so during a lawsuit do they openly question you about your marital status? Also when we obtained the marriage certificate they asked if either of us had been married previously, he had but he checked no because he couldnt find his divorce papers, so does that make our marriage null and void?

My grandpa, 73 years old went in for an aortic replacement surgery.

The surgery is supposed to be around 6 hours and 90% full recovery rate.

The pre-surgery test revealed all organs in good shape and he was healthy by most means. No prior surgeries or heart problems, or medical conditions. No existing diseases, nothing really wrong. Good overall health.

What required the surgery was that his aorta had swollen to 5 centimeters.

The surgery went well as planned but…

-Part of the procedure is to drain the heart.

-To drain the heart a tube must be inserted into the atrium.

-While doing so, the doctor tore the atrium; this led to a 14 hour surgery.

-When it tore, they stitched it, the stitches tore further in.

-Finally, they stitched it back, but the wound was bleeding severely.

-Since they could not fix it, they inserted sponges/packs to add pressure to the heart in the place of the tear to stop bleeding.

-They left his chest cavity open, overnight for 24 hours total.

-In the morning, they closed him up right away because the doctor claimed he was impressed with the healing of the bleeding.

-After they closed him, the doctor came back with and said that it went well.

-Soon after his hearts started to fail. The burden of the 14 hours was too much.

Had they not torn the atrium he would have had a normal surgery and not subjected to exhausting and severe surgery.

There was a way to prevent the tear. Had the doctor used adequate precautions, it would have been ok.

What do you think?

(ps, as of now, he is still alive on pacemaker (respirator) about 9 or 10 drips or more. The doctor said at his stage, patients do not come back.)

We settle out of court for my daughter’s estate (Indiana) We were only awarded her funeral costs and layers fees($17000). We let them make payments to us in what they wanted it to offer. It has gone through the courts. Now we get a legal bill after everything for the lawyer trying to collect the money and put a process to collect on them for $860 and maybe more. since this is a seperate issue, can we take them to small claims to colect that. Would we have a chance to win?
I think we let them off easy and let them decide their payments and now we have topay to collect it?
It was a wrongful death for serving her underage at a bar which had no insurance and the bartender had no liscense to sell.
She had a .19 in 4 hours and should have never left the bar, even if she was of age.(all of this has been proven.)

The lawsuit was filed Friday in Los Angeles Superior Court by Jamiel and Anita Shaw, the parents of the late Jamiel Shaw II. The deceased teen’s brother, Thomas Shaw, also is a plaintiff.

They family members name as defendants the county, Sheriff Lee Baca and their son’s alleged killer, Pedro Espinoza.

The relatives also are alleging negligence, violation of the Immigration and Nationality Act and deprivation of civil rights. They are seeking unspecified damages.

Steve Whitmore, a spokesman for Baca, said he had not seen the lawsuit and declined to comment.

Shaw, a Los Angeles High School football player, was shot and killed in March 2008, allegedly by Espinoza, an alleged gang member who was in the country illegally.

According to the lawsuit, deputies negligently released Espinoza from jail on March 1, 2008, despite knowing he was “a dangerous felon and an immigration violator.”

Shaw was shot at 8:30 p.m. a day later in the 2100 block of 5th Avenue while talking with his girlfriend on the phone two doors from his home.

The lawsuit also alleges that Espinoza, a Latino, targeted Shaw because he is black.

The 20-year-old Espinoza, who is charged with murder, is scheduled to be arraigned June 30.

“Jamiel’s Law” would have given Los Angeles police officers the right to arrest undocumented gang members before they commit crimes.
